According to the Resolution of the Cabinet of Ministers of Ukraine No. 150 dated February 15, 2002

 Foreigners and stateless persons who legally arrived in Ukraine may temporarily stay in its territory:

1) during the visa issued by the visa within the term of validity of the visa in case of entry of stateless persons or foreigners who are citizens of the states with the visa procedure, unless another term is specified in international agreements of Ukraine;

        2) not more than 90 days within 180 days in case of entry of foreigners who are citizens of states with a visa-free entry procedure, unless another term is specified by international agreements of Ukraine.

         3) for the duration of the visa, but not more than 90 days for 180 days in the case of entry for a visa issued before September 11, 2011.

The term of stay of foreigners and stateless persons on the territory of Ukraine is prolonged in the case when they arrived:

• for a short-term visa, as well as from states with a visa-free regime of entry in the presence of well-founded grounds (treatment, pregnancy or childbirth, care for a sick family member, registration of the inheritance, filing an application for obtaining a permit for immigration or obtaining citizenship of Ukraine, performance of official duties of a foreign correspondent or representative of a foreign mass media, etc.) and provided that the supporting documents are submitted — for a period of existence of such grounds, but not more than 180 days from the date of the last entry into Ukraine . Visas to the short-term visa are equivalent to the visas of type С-2, С-3, Б, Л, М, Н, Р, Г, К, Т, П-1, ОП, П-2, (the term of their action);
• for a transit visa in case of forced stop on territory of Ukraine in connection with extraordinary circumstances (natural disaster, illness, repair of a vehicle, etc.) in the presence of a document confirming the reason and duration of the forced stop — for the period necessary to eliminate such circumstances. Visa visas of the type TP-1 and TP-2 are equivalent to transit visas, issued before September 11, 2011 (before the expiration of their validity period);
• for a long-term visa, if during the term of validity of the visa for valid reasons, certificates for permanent or temporary residence, provided that the supporting documents are submitted, are not issued for a period of not more than one month. Visas, such as O, IM-1, IM-2, IM-3 and F, are issued for long-term visas, issued before September 11, 2011 (before the expiration of their validity period).

Applications for extension of stay on the territory of Ukraine (hereinafter — applications) shall be submitted by foreigners and stateless persons and the host party not earlier than ten and not later than three working days before the expiration of such term to the territorial bodies or units of the LCA at the place of residence.

      The term of application shifts.

No more than three business days. If additional inspections are necessary, this period may be extended to ten, and in the case of submission of documents for decision of the LCI — fourteen calendar days.

• actions of a foreign business entity to transfer a foreigner or stateless person to work in Ukraine and a contract concluded between a foreigner or a stateless person and a foreign business entity, for transfer to employment in Ukraine — for intra-corporate cessions;
• the labor contract (contract), but not more than one year, for all other foreign hired employees.

CONFIRMATION OF THE CHILDS CITIZENSHIP

In Ukraine, there is a legal procedure established by law, which defines the main circumstances when a child needs confirmation of citizenship.
According to the Law of Ukraine «On Citizenship»: «Children born on the territory of Ukraine are citizens of Ukraine».
If both parents of a born child have Ukrainian citizenship, in this case, the confirmation of citizenship for the child is unnecessary.
However, when one of the parents is a citizen of Ukraine, and the other is a foreigner, or both parents are foreigners and they are legally residing in the territory of the state. In such marriages, children born on the territory of Ukraine issue a birth certificate.
A newborn’s certificate is not an automatic obtaining of citizenship of Ukraine. In the future, the procedure for confirming the citizenship of Ukraine, based on which the certificate is issued to parents, is required for such children.

OBTAINING PERMANENT RESIDENCE FOR INVESTMENT

One of the grounds for a stateless person or a foreigner to obtain a permanent residence permit in Ukraine is a foreign investment in the Ukrainian economy in a foreign convertible currency for a sum not less than one hundred thousand dollars.The immigration permit is granted within the limits of the immigration quota, in accordance with Article 4 of the Law of Ukraine «On Immigration». Answers to questions that arise when investing in Ukraine: How should a foreigner or a stateless person make a foreign investment?
In order to optimally make a foreign investment in the Ukrainian economy — it is necessary to create and register a legal entity in accordance with the legislation of Ukraine. Or to make a share in the authorized capital of an already operating company.  In what currency is a foreign investment? You can invest in a foreign currency, which is recognized as convertible by the National Bank of Ukraine, the most common ones are the US dollar and the euro. The hryvnia for the investment will not fit. As according to the Law on Immigration, it is a question of a foreign convertible currency. The same applies to other forms of investment. Shares and corporate rights — although they qualify as an investment, but are not the basis for obtaining a certificate.In order to make an investment in the future, a foreigner or stateless person needs to open an investment account with a bank in Ukraine. The opening of this type of accounts is governed by the Instruction approved by the Resolution of the Board of the National Bank of Ukraine How is foreign investment practiced in practice? And what confirms this?According to paragraph 1 of the Resolution of the NBU Board «On Approval of the Classifier of Foreign Currencies», convertible currencies are those that are widely used to make payments for international transactions and currencies of the European Union member states (US dollar, euro, zloty, yen, pound sterling, Czech crown, etc.).

That is, a non-resident must make an investment in cash in foreign currency equivalent to not less than 100 thousand US dollars (according to the official NBU rate on the date of the investment). Although the legislation abolished the mandatory state registration of foreign investments, it is always necessary to obtain a certificate from the bank on the receipt of funds. Banks and their separate subdivisions (branches, representative offices, branches) issue a person without citizenship or a foreigner a certificate on the receipt of foreign investment in the economy of Ukraine.

The certificate contains information on the receipt of the investment into the relevant account in the form of a foreign convertible currency (made by a stateless person or a foreigner), in the amount of one hundred thousand dollars. The investment must be made in the economy of Ukraine. Sign the head of the bank (or its separate subdivision: branch, branch, representative office). Also, the date of issue and the number must be indicated. The certificate is verified by a seal and is valid for six months from the date of issue.The term for considering an application for an immigration permit can not exceed one year from the date of its submission.  Is the purchase of housing in Ukraine an investment that gives the right to obtain a permanent certificate? Foreign citizens who wish to receive a residence permit on the basis of investments erroneously consider that the purchase of housing in the territory of Ukraine for the amount of 100 thousand US dollars grants a right to permanent residence.However, this is not the case. By how much an apartment purchase is an investment of money for personal needs which is not aimed at the development of the state’s economy, such an investment will not be considered an investment, and therefore it will not give the right to obtain a permanent residens.
